Terms of Use

Agreement

By using Conciera (the "Service"), you agree to these terms. If you are using the Service on behalf of a practice or organization, you confirm that you have authority to bind that entity to these terms. These terms are governed by the laws of Ontario, Canada.

What Conciera is and is not

Conciera is a call routing and screening service. It answers inbound calls, identifies caller intent, routes calls to your staff, and filters solicitors and robocalls.

Conciera is not a medical device, a clinical decision support tool, or a telehealth service. It does not provide medical advice, triage symptoms, or make clinical recommendations. It is not a replacement for a pharmacist, physician, or any regulated health professional.

You are responsible for ensuring your front-desk and clinical workflows remain compliant with applicable law regardless of how you use Conciera.

Pilot terms

Pilots are provided at no charge for a defined period agreed at the start of the engagement. At the end of the pilot period, you may choose to continue on a paid plan or discontinue. There is no obligation to continue.

During the pilot, Conciera may collect call data, transcripts, and usage metrics to improve the service. You may request deletion of pilot data at any time.

Paid plans

Paid plans are billed monthly. You may cancel at any time; cancellation takes effect at the end of the current billing period with no prorated refund. We reserve the right to change pricing with 30 days' written notice to active subscribers.

Your responsibilities

  • Provide accurate information when setting up your account and call flows
  • Ensure that call recording disclosures to patients comply with applicable provincial law
  • Not use Conciera to deceive callers, engage in fraudulent activity, or violate any applicable law
  • Keep your account credentials secure and notify us of any unauthorized access
  • Ensure that your use of inbound call data complies with PHIPA, PIPEDA, and applicable provincial health privacy law

Service availability

We aim to maintain high availability but do not guarantee uninterrupted service. The Service depends on third-party providers including telephony, AI, and cloud infrastructure. We are not liable for outages caused by third-party failures. We will make commercially reasonable efforts to notify you of planned maintenance in advance.

Limitation of liability

To the maximum extent permitted by law, Conciera's total liability for any claim arising from your use of the Service is limited to the amounts you paid us in the three months preceding the claim.

We are not liable for any indirect, incidental, consequential, or punitive damages, including lost revenue, missed patient calls, or data loss, even if we were advised of the possibility of such damages.

Intellectual property

The Conciera name, brand, software, and call flow logic are our property. You retain ownership of your practice's data, including call records and transcripts generated through the Service. We may use aggregated, anonymized usage data to improve the Service.

Termination

Either party may terminate the agreement at any time. We may suspend or terminate access immediately if we believe you are using the Service unlawfully or in violation of these terms. Upon termination, your data is retained for 90 days then deleted, unless you request earlier deletion.

Changes

We may update these terms. For material changes, we will notify active account holders by email at least 14 days before the change takes effect. Continued use after that date constitutes acceptance of the revised terms.
